This talk will go over the tools provided in CEQA for lead agencies to streamline their environmental review, from tiered environmental review, Program and Master EIRs, to focused initial studies, incorporation by reference and the use of exemptions.  The speakers will provide the benefits and risks of using the various streamlining tools. There will also be an overview provided of the latest legislation and discussion of future streamlining efforts.

 

John W. Fox is a partner of Phelan Fox Law.  He earned his juris doctorate from Loyola Law School in 1993.  From 2005 to 2011, John worked for the Fresno City Attorney’s Office as a Deputy City Attorney, where he advised staff and leadership on all aspects of land use law, including the California Environmental Quality Act, Brown Act, Political Reform Act, Subdivision Map Act, Mitigation Fee Act, Public Records Act, Cortese-Knox-Hertsberg Act. Among other things, John assisted with the drafting of significant amendments to Fresno’s Zoning Ordinance, and advising staff on the preparation of a new community and specific plan for Fresno’s downtown and a major update of the City’s General Plan. 

 

Kathryn C. Phelan is a partner of Phelan Fox Law, and earned her juris doctorate from Pepperdine School of law in 2000, where she graduated summa cum laude.  She also received a Master’s degree in Urban Planning from UCLA in 2011.  Kathryn joined the Fresno City Attorney’s Office in 2001, and took over the “Land Use Desk” in 2003.  During her eight years with the City, she gained a broad range of municipal law experience. At various times, Kathy was the principal advisor to the City on CEQA, the Subdivision Map Act, State Planning and Zoning Law, the City's Mobilehome Rent Control Ordinance, Historical Resources, ADA Compliance, Group Homes, and Redistricting.  Kathy also sat as the advisor to the Planning Commission and conducted numerous training presentations to City staff and Boards and Commissions on CEQA, the Brown Act, the Political Reform Act, as well as defended the City in Court on numerous writ matters.
